have been laid down by the DC Court of Appeals. This places the discretion for disappearances in the hands of the feds, who are, note, considering disappearing citizens. The successful capture of the first actual American al-Qaeda member (the guy who was going to topple the brooklyn bridge with a pair of wire cutters and a blow torch...) doesn't compare too favorably to the detentions of thousands and hundreds of arrests made since 9/11 - none of which succeeded in much more besides ruining people's lives.
