I just have a hard time believing that Wal-Mart tried to ban an employee from wearing a pro-union t-shirt when he was off-duty in the first place. Well... not that hard. But while they were the shooting that down the 8th circuit court said that it's legal to discipline a worker for talking to other workers about the possibility of someday in the future maybe signing a request to form a union is a big no no. Seems like an absurd violation of the right to free association. Sooner than later all "right to free assication" is going to protect in the workplace is the making of incongruous juxtapositions off the job.
